Terms of Service
The short version. Your notes stay yours. Be of legal drinking age, be honest, do not abuse the service. Paid features are billed through Stripe and you can cancel any time. Winote is a tasting tool, not advice about drinking.
The agreement
These terms are an agreement between you and SparrowSoft, which operates Winote ("Winote", "we", "us"). By creating an account, joining a tasting or otherwise using winote.app or the Winote iOS app, you agree to them and to our Privacy Policy. If you use Winote for a business, you agree on its behalf and confirm you are allowed to.
Who can use Winote
You must be of legal drinking age where you live. Winote does not sell, ship or deliver alcohol, and nothing in it is an offer to.
Your account
You sign in with a code sent to your email address or with a passkey, so keeping your email account and devices secure keeps Winote secure. You are responsible for what happens under your account. Give us accurate information, and tell us promptly if you think someone else has access.
Your content
Your tasting notes, scores, photos, portfolios and everything else you put into Winote remain yours. You give us permission to store, display and process that content only as needed to run the service for you, including sharing it as described under "Hosted tastings" and in the Privacy Policy.
The wine catalog is shared. When you add a wine that is not already in it, the wine's factual details (producer, name, vintage, region, grape) join the catalog for everyone, and you give us a lasting license to keep them there. Your notes and scores do not.
You are responsible for having the rights to what you upload, including logos and label photos.
Hosted tastings
If you are a guest, the notes and scores you submit for an event are shared with the organization hosting it, which may use them and may contact you about the wines.
If you are a host, you are responsible for your event, for complying with the alcohol laws that apply to it, and for how you use what your guests tell you. Use guest information only to follow up about your wines and tastings, honor requests to stop, and do not sell it.
Acceptable use
Do not use Winote to break the law, to harass anyone, to send spam, or to promote drinking to people under the legal age. Do not try to break into the service, overload it, scrape it, copy the catalog in bulk, or get at other people's data. Do not resell Winote without our written agreement. We may suspend accounts that do these things.
Paid plans
Winote is free to start. Some features, such as larger events and team plans, are paid. Prices are shown before you buy. Payments are processed by Stripe. Subscriptions renew automatically until you cancel, which you can do at any time from your billing settings and which takes effect at the end of the period you have paid for. One-time event upgrades are not refundable once the event has started. Otherwise, if something went wrong with a charge, write to us and we will make it right. We will give notice before changing the price of a plan you are on.
What is ours
The Winote name, logo, software, design and the catalog as a compiled whole belong to SparrowSoft. WSET and Court of Master Sommeliers are the names of independent organizations. Winote supports their tasting formats and is not affiliated with, sponsored by or endorsed by either.
Ending things
You can stop using Winote and ask us to delete your account at any time by emailing hello@winote.app. We may suspend or close an account that breaks these terms or puts the service or other people at risk. If we ever shut Winote down, we will give reasonable notice and a way to get your notes out first.
Disclaimers
Winote is provided "as is" and "as available". We work hard to keep it accurate and running, but we do not promise it will be uninterrupted or error-free, and catalog and reference information may contain mistakes. Winote is not medical, health or legal advice. Please drink responsibly.
Limits on liability
To the fullest extent the law allows, SparrowSoft is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim about the service is limited to the greater of what you paid us in the twelve months before the claim or one hundred US dollars. Some places do not allow these limits, so parts of this section may not apply to you.
Governing law
These terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-law rules. Disputes will be heard in the state or federal courts located in Georgia, and you and we consent to their jurisdiction. If a court finds part of these terms unenforceable, the rest still stands.
Changes
We may update these terms as Winote grows. If a change matters, we will update the date at the top and tell account holders by email before it takes effect. Using Winote after that means you accept the new terms.
